Description

William Henry Hammond, a federal prisoner, appeals the district courts summary dismissal of his motion, pursuant to 28 U.S.C. § 2255, to vacate his sentences. Hammond was sentenced to concurrent terms of 20 years for bank robbery and 5 years for conspiracy to commit bank robbery upon his pleas of guilty. Because we think that he has alleged facts which, if proven, demonstrate that he was not afforded effective representation of counsel, and that his pleas were involuntary, we reverse and remand the case for a plenary hearing.
